SPRINGVILLE, NY (WIVB)  Just before 1am Sunday morning, Erie County Sheriff  Deputy Don Hoelscher  allegedly spotted a vehicle turn north onto the Rt 219 expressway at a high rate of speed and drive shoulder to shoulder on the highway.

After getting the vehicle stopped, Deputy Hoelscher arrested the driver: Hugh D. Smith, 41 years old,  and charged him with Felony DWI, Felony Aggravated Unlicensed Operation (revoked license for the DWI’s), Operating a vehicle without an interlock device, Unsafe Turn, and Failure to Stay in Lane.

Smith has 2 prior convictions for DWI from 2011 and 2012 and his license had been previously revoked.

A breath test revealed his blood alcohol content to be .20%. He was processed at the Springville Station and transported to the Holding Center to await arraignment in Concord Court.

This was the 9th arrest for DWI by Sheriff’s Road Patrols in 2014.
