Woman charged with second DWI in 5 months

A woman who was arrested for DWI last year after a clerk refused to sell her alcohol was arrested again on Thursday for DWI after State Police found her passed out behind the wheel of her car in a liquor store parking lot.

Troopers responded to Passport Wines and Spirits on Main Street in Clarence around 3:30 p.m. and found 44-year-old Elizabeth Simmons slumped behind the wheel. Officers checking on her condition say Simmons showed signs of being heavily intoxicated.

According to police, she failed field sobriety tests and a breath test revealed her BAC to be .23 percent. She was arrested for aggravated felony DWI.

Last August, Simmons was charged with DWI after a clerk at a gas station on Goodrich Road refused to provide her alcohol and then called police when she drove away from the scene. In that incident, she refused to take a breath test.
