ALDEN, N.Y. (WIVB)- Drugs are believed to be a factor in a crash at Main Street and Sandridge Road, in the Town of Alden, Wednesday night. The Erie County Sheriff’s Office says they arrested 30-year-old David Wilczak around 8:45 p.m. Wilczak had a five-year-old and a nine-year-old in his vehicle at the time of the accident.
Deputies responded to the crash and a drug recognition expert determined Wilczak was impaired by drugs. He admitted to deputies that he had used heroin that day, and refused to submit a blood test.
Wilczak is charged with driving while ability impaired by drugs and two counts of Leandra’s Law. He was taken to Erie County Holding Center pending arraignment.
