Man charged with 2 counts of Leandra’s Law

Friday night, Orchard Park Police pulled over a vehicle with expired, out of state plates on California Rd..

Police say the driver of the vehicle, 45 year old Burke W. Forster of Orchard Park,  had a BAC that was almost twice the legal limit and his 11 year old son was in the car.

Forster was charged with 2 counts of Leandra’s Law, felony DWI, endangering the welfare of a child, unregistered motor vehicle, uninsured motor vehicle and speeding. Burke was previously convicted of DWI in 2011, upgrading the recent DWI charge to a felony.

Forster was released after posting $200 bail and is scheduled to appear in court later on this month.

Orchard Park Police made two other DWI arrests Friday night.

28 year old  Timothy J Hourihan of West Seneca was pulled over on Southwestern Blvd for failing to maintain lane and making an improper turn.  Police say his BAC was .17%. Hourihan was charged with Driving While intoxicated.

Police also charged 22 year old Richard M Spencer of East Concord with DWI after pulling him over on Orchard Park Rd..
