Two men found lying on side of road facing charges

WARSAW, N.Y. (WIVB) – Two men were arrested in Wyoming County after deputies found them lying on the side of the road in the Village of Warsaw.

Authorities say the pair were seen on Sunday lying off of Buffalo Street, and both appeared to be on drugs. They were taken to the hospital for treatment.

Deputies determined one of the men, 20-year-old Benjamin Evans of Warsaw, had been staying at a local motel and that 21-year-old Devin Miller of Perry had been staying with him. A search of the room uncovered drug paraphernalia and a stolen NYS license plate.

Evans and Miller were both arrested upon their release from the hospital and charged with seventh degree criminal possession of a controlled substance. Evans was additionally charged with fifth degree criminal possession of stolen property.

Miller was released and is due in court next month. Evans was taken to the Wyoming County Jail on $5,000 bail.
