MAYVILLE, N.Y. (WIVB) – A Western New York man originally charged under the state’s new gun law has been convicted of selling an illegal assault weapon to an undercover investigator.
Charges against Benjamin Wassell of Silver Creek under the SAFE Act were later dropped from the indictment. But a jury found him guilty Monday of four felony counts.
In January 2013, the 32-year-old sold an illegal DelTon DTI-15 assault rifle to an undercover State Police officer. But because the rifle had a pistol grip, telescoping butt stock, and a bayonet mount, it is considered illegal under the penal law.
When Wassell is sentenced, he faces up to seven years in prison.
