16-year-old accused of viciously assaulting boy

EVANS, N.Y. (WIVB) – Evans Police are investigating a serious fight between a 16-year-old and a 12-year-old that sent the younger boy to the hospital.

Lt. Peter Smith of the Evans Police Department says the fight happened Sunday on Commercial Street in Angola. Witnesses say the 12-year-old victim was knocked unconscious for a time after being savagely beaten and then kicked in the face.

He was taken to Women and Children’s Hospital of Buffalo and released a short time later. After being released, investigators say the boy reported he had his cell phone stolen and was burned with a cigarette. Police are still working to validate those claims.

“We believe there was some build up to it. There had been nothing prior to this, for lack of a better word, kids being kids and handled it the wrong way,” Lt. Smith said.

Police say a neighbor, who lives in an apartment building close to where the fight took place, called 911. The incident happened a block away from the fire department and Angola Village Hall.

Lt. Smith says the victim has facial injuries and two other kids may or may not have been involved in this fight. News 4 is told the kids are all Lake Shore Central School District students and they know one another. Their names are not being released, but police say they may faces charges as well.

The 16-year-old has been charged with third degree robbery, second degree assault degree, harassment, petit larceny and conspiracy. Though the teenager is being charged as an adult, police will not release the teenager’s name because of the possibility of getting youthful offender status.

Police say their investigation continues.
