80-year-old man facing second DWI charge

DAYTON, N.Y. (WIVB) – An 80-year-old man was arrested for a second DWI after crashing his truck into a ditch on Rt. 62 in the Town of Dayton late Saturday night.

Deputies were called shortly before midnight after a passerby spotted the truck, but the driver was nowhere to be found. Authorities tracked down Franklin Nephew of Versailles and brought him back to the scene, where he was subsequently arrested.

Nephew’s license is currently revoked for a prior DWI conviction. In his vehicle, deputies say they found open beer cans.

Nephew was taken to the Cattaraugus County Jail on $500 bail after being arraigned on charges of felony DWI, first degree aggravated unlicensed operation, driving without an ignition interlock device, speed not reasonable, leaving the scene of an accident, failure to maintain lane, and consuming alcohol in a motor vehicle.
