ORCHARD PARK, N.Y. (WIVB) - An Orchard Park mother accused of putting pure alcohol into her baby’s milk has been cleared of all charges.
Kimberly Lawton was charged in October 2013 with felony attempted assault and tampering, five months after the infant’s biological father gave investigators a bottle of breast milk he claimed may have been tampered with. Investigators said the contents tested positive for ethanol.
The Erie County District Attorney attempted to indict Lawton on the charges, but the grand jury returned a “no bill.” That means they did not believe the evidence backed up the charges.
The baby was never hospitalized and investigators did not say whether he showed any signs of sickness.
Now that the charges are dismissed, a court date is set to discuss custody of Lawton’s children.
