Man allegedly injured person, damaged car during dispute

SCIO, N.Y. (WIVB) – Troopers say a southern tier man injured a person, damaged a vehicle and nearly caused a wreck during a dispute on Saturday.

State Police charged Franklin Smith of Scio with third degree assault, first degree reckless endangerment, third degree criminal mischief, fourth degree criminal possession of stolen property, third degree criminal possession of a weapon and tampering with physical evidence.

Authorities say the 21-year-old got into a fight with a person, causing them physical injury, before damaging a car and interfering with the vehicle’s operation, nearly causing a wreck.

At the scene, troopers say Smith threw a stolen handgun into a creek to avoid having it discovered. But officers were able to get it out of the water.

Smith is being held in the Allegany County Jail on $25,000 bail. provides commenting to allow for constructive discussion on the stories we cover.
