Police stop drunk driver after seeing beer can thrown out window

ELLINGTON, N.Y. (WIVB) – It wasn’t hard for State Police to spot an alleged drunk driver. Troopers say they watched the suspect throw a beer can out the window as he was driving on Wade Hill Road in the Town of Ellington.

After pulling 24-year-old Mikol Rockwood of Irving over on Saturday, officers say they could smell alcohol coming from the vehicle. Rockwood allegedly failed field sobriety tests and had a BAC of .13 percent.

He and his 17-year-old passenger were taken to the police station, where Rockwood was charged with felony DWI under Leandra’s Law, felony first degree aggravated unlicensed operation, unlawfully dealing with a child for providing alcohol to a person under the age of 21, and unlawful possession of marijuana.
