Wyoming County ADA loses job after domestic incident


ATTICA, N.Y. (WIVB) – An assistant district attorney in Wyoming County has lost his job after being arrested in a domestic incident.

Marshall Kelly, 33, is accused of third-degree assault and second-degree criminal trespass during a domestic incident in the Village of Attica.

District Attorney Donald O’Geen says Kelly worked in his office for more than four years. He says instructed the Wyoming County Sheriff to seize Kelly’s credentials when he learned about the incident. He then terminated Kelly’s employment.

Genesee County District Attorney Larry Friedman was appointed as special prosecutor to the case.

O’Geen released a statement with this information Monday morning, saying, in part, “My office has always taken a strong stance against domestic violence and this type of behavior will not be tolerated in any form.”
