Paladino loses attempt to deny Nevergold vote

BUFFALO, N.Y. (WIVB) – -Buffalo School Board member Carl Paladino has lost his attempt to deny Buffalo School Board president Dr. Barbara Seals Nevergold her vote on the board.

Paladino had contended that Dr. Nevergold should have had to run for the seat she been appointed to fill in 2011, when she replaced Chris Jacobs on the board. Jacobs became Erie County Clerk.

State Supreme Court Justice Tracey Bannister based her decision primarily on the fact that Paladino’s similar complaint had been earlier denied by the State Education Department. He had sought to prevent Dr. Nevergold from voting in any future matters, as well as attempting to negate all her votes from 2013 onward.

Justice Bannister also noted that Paladino could have made his case before the 2013 school board elections, when he says Dr. Nevergold should have run for the seat. Since she legally occupied that seat and wasn’t compelled to run in 2013, the judge ruled she remains legally entitled to occupy the seat and vote in school board matters.

Dr. Nevergold told reporters Tuesday she was pleased with Judge Bannister’s decision, which she said will prevent more chaos for the district.

“I try not to take it personally, but I do take it personally,” she said. “I will continue to work with Mr. Paladino professionally, but it is hard to trust him.”
