Court adjourned for man accused of boy’s death


BUFFALO, N.Y. (WIVB) - Court was adjourned Wednesday, for a Buffalo man who was charged with sexually assaulting and killing his girlfriend’s five-year-old son.

Kuzdzal’s defense attorney says they adjourned Wednesday’s hearing because if they went forward with it, the Erie County District Attorney’s Office policy says there cannot be any plea deal offered going forward. The defense has an obligation to explore every option for their client.

Right now every option on the table has a maximum sentence of life in prison. If the DA doesn’t offer a determinant sentence, the defense says they will go to trial, otherwise they’re not doing their jobs as defense attorneys. District Attorney Frank Sedita had no comment.

They will be back next Thursday for a hearing. There were several detectives from homicide and police in court Wednesday.

In September, Eain’s grandmother, Robin Hart, lamented, “I never thought there would be the day where I would have to bury one of my grandchildren.”

“He laughed all the time. He was the most beautiful child there was. I don’t even know how to describe him, he was too perfect.”
