BRANT, N.Y. (WIVB) – State Police say a man found early Tuesday morning asleep behind the wheel of his vehicle was intoxicated.

Troopers found Jeremie Sommers of Cherry Creek asleep behind the wheel of his vehicle on Rt. 5 around 1 a.m. Officers say the 24-year-old had left the vehicle in gear and had his foot on the brake with his vehicle stopped partway on the sidewalk and partway in the eastbound driving lane.

A breath test reportedly revealed Sommers BAC to be .11 percent. He was charged with DWI and is due back in Town of Brant Court in June.
