Mother in baby bottle case suing boy’s father and police

ORCHARD PARK, N.Y. (WIVB) – Kimberly Lawton, who the Erie County District Attorney says was wrongly accused of poisoning her baby’s bottles, is suing the Orchard Park Police Department and Thomas Meyers, the boy’s father.

In May, Lawton exclusively shared with News 4 the pain of being jailed, charged, and having her children taken away all for what District Attorney Frank Sedita determined was a false accusation.

In the lawsuit, Lawton accuses Meyers of adding foreign substances to bottles before turning them over to Orchard Park Police as evidence in an attempt to gain sole custody of their baby. Lawton accuses police of being malicious and reckless.

Before the criminal charges were dropped, Child Protective Services determined Meyers’ complaint was unfounded.

Sedita says the crime lab found trace amounts of ethanol in the baby bottles, which probably occurred naturally, as part of the fermentation process.

Lawton and her attorney did not want to comment on the lawsuit. Meyers also declined to comment.
