BUFFALO, N.Y. (WIVB) – A Buffalo man admits to driving drunk when his 1-year-old son was inside the car. Jerry Rutledge, 58, admitted to drinking and smoking marijuana in January, when his vehicle struck an SUV, causing it to strike a pedestrian.
Officers responded to William Street, in Cheektowaga, to investigate. Rutledge tried to hide bottles of gin under his son’s diapers, according to Erie County District Attorney Frank Sedita.
A blood test revealed an alleged blood alcohol content of .31 percent, nearly four time the legal limit.
Rutledge pleaded guilty to aggravated DWI with a child in the car, the highest charge he could have been convicted of. Rutledge faces up to four years in state prison when he is sentenced on December 1.
