NIAGARA FALLS, N.Y. (WIVB) – A Niagara Falls business admitted to negligent endangerment under the Clean Air Act, according to the U.S. Attorney’s Office. Tier NY, LLC, admits to releasing an unknown amount of hydrochloric acid gas that traveled to a nearby business, and placed people in imminent danger of death or serious injury.
Tier NY, LLC, cleans tanks that once carried hazardous materials, including titanium tetrachloride. When this is combined with water, it forms hydrochloric acid gas which is a hazardous air pollutant.
On June 11, 2013 employees allegedly cleaned a tank and combined materials that caused the release of the hazardous pollutant.
The U.S. Attorney’s Office said the corporation will learn its sentence in January. It could be fined up to $200,000 and a possible term of probation up to five years.
