Judge delivers strong words, 25-year sentence

BUFFALO, N.Y. (WIVB) – A judge had some strong words for a killer before sentencing him to 25 years behind bars. Andre Johnson, 20, shot and killed Robert Bennett, 70.

The victim was found dead at his home on C Street, with a gunshot wound to the back of his head. Family members said his wallet and cellphone were taken.

Johnson apologized in court and said he was a drug user. State Supreme Court Justice William Boller told Johnson, that’s not an acceptable excuse.

Boller said, “Let the record be clear. This court does not take being being drunk or using cocaine as any mitigated factor at all.  Unfortunately, there are a lot of drunks out there and a lot of cocaine addicts and they never, ever put a gun to the back of an old man’s head, to pull the trigger. Don’t blame drugs, don’t blame alcohol, there is something deep inside you that’s real wrong.”

Twenty-five years was the maximum Johnson could have received.
