NEWSTEAD, N.Y. (WIVB) — Police in the Town of Newstead are attributing a DWI arrest to the call of a concerned citizen reporting a driver who ran into a ditch after dangerous driving.
New York State Police say Troopers responded to the scene scene Saturday and found Thomas H. Baehr, 65, stranded with his vehicle’s passenger side wheel completely removed from his car stopped in the northbound lane of Cummings Road.
Troopers said Baehr told them he lost control of the vehicle due to the road conditions and his speed. He said he ran into a ditch, and his vehicle slid into the roadway after.
While Troopers were investigating the scene, they smelled alcohol strongly on Baehr. Troopers arrested him after giving him field sobriety tests.
After giving Baehr a breathalyzer test, they said his blood alcohol content was .16 percent, twice the legal limit. They charged him with a felony DWI, as he’s been convicted of a DWI within the past 10 years. They also charged him with speed too fast for conditions.
He’ll return to the Town of Newstead Court on Jan. 21.
