Corporation sentenced for violating Clean Air Act

NIAGARA FALLS, N.Y. (WIVB) – A Niagara Falls corporation was sentenced Thursday for negligent endangerment under the Clean Air Act. In October, Tier NY, LLC, admitted to releasing an unknown amount of hydrochloric acid gas that traveled to a nearby business.

Tier NY was sentenced to two years probation and a $25,000 fine. U.S. Magistrate Judge Hugh B. Scott also ordered the company to make $25,000 in capital improvements, and develop and institute an environmental training program.

Tier NY, LLC, cleans tanks that once carried hazardous materials, including titanium tetrachloride. When this is combined with water, it forms hydrochloric acid gas which is a hazardous air pollutant.

On June 11, 2013 employees allegedly cleaned a tank and combined materials that caused the release of the hazardous pollutant. provides commenting to allow for constructive discussion on the stories we cover.
