NIAGARA FALLS, N.Y. (WIVB) — New York State Police arrested a man in Niagara Falls after finding him passed out behind the wheel at a gas station.
Troopers say they pulled up behind Mark A. DeFranco, 29, at a Sunoco Gas Station and found him passed out in the driver’s seat, keys still in the ignition and the motor still on. Troopers say DeFranco got out of the car when they woke him and stumbled three times into the vehicle. Troopers say he also dropped his cell phone while talking about it, and when taking the field sobriety test, failed.
DeFranco eventually was arrested for DWI/DWAI drugs. Police say while arresting them they found suboxone, a bottle of 13 ambien pills, clonazepam and lyrica.
Police say DeFranco refused a breathalyzer test and drug recognition evaluation test. He was charged with DWI drugs, refusal to take a breath test and unlicensed operator. He’ll be back in court on March 12.
