Man accused of .23 percent BAC

SINCLAIRVILLE, N.Y. (WIVB) – A Sinclairville man was drunk when he drove away from a domestic violence scene on Saturday afternoon, according to New York State Police. Police said 49-year-old Brian M. Tarbell was pulled over on Charlotte Center Road.

Police were called to the domestic violence scene, and ended up stopping Tarbell for having no left side mirror. They said he had a blood alcohol content of .23 percent, nearly three times the legal limit.

Tarbell was charged with aggravated drunk driving and menacing. He was arraigned in Town of Charlotte Court. provides commenting to allow for constructive discussion on the stories we cover.
