Man allegedly drives drunk with 3-year-old

ORCHARD PARK, N.Y. (WIVB) — A Lancaster man is accused of violating Leandra’s Law by driving drunk with a child in the car Wednesday morning around 11:30 a.m.

Police in Orchard Park say they stopped Mark A. Sypniewski, 53, for driving through a red light. After stopping him, police say he seemed drunk. Police say he failed subsequent field sobriety tests.

As his 3-year-old granddaughter was in the car, he was arrested and charged with DWI, felony DWI (Leandra’s Law), open container, littering and endangering the welfare of a child.

Police say he refused to take tests after being arrested. He’ll be arraigned, but police say this is his second alcohol related arrest. provides commenting to allow for constructive discussion on the stories we cover.
