BUFFALO, N.Y. (WIVB) – Former Erie County District Attorney Frank Clark said the county’s current DA Frank Sedita revealed a lot during the press conference about the Patrick Kane investigation.
Sedita said the accuser’s mother is responsible for telling the family lawyer an evidence bag was dropped at her front door and tampered with. Sedita called it a bizarre hoax.
After the press conference, Clark said that first thing that stood out to him was a comment Sedita maid. The DA said it’s not a question of when this case goes to the grand jury, but if it does.
“If he’s only at the point where it’s still “if,” then there are significant proof problems in his mind and there’s a significant question in his mind as to whether this event ever happened at all,” Clark said.
Clark said a red flag was raised when he heard the Sedita can’t speak to the victim without her lawyer present.
“I’ve never heard of that,” Clark said. “That’s not conducive to a good relationship between the prosecutor and the victim.”
After hearing all the facts, Clark said the accuser’s mother could be charged with obstructing governmental administration.
The News 4 Legal Analyst also believes the accuser’s mother’s motivation behind the hoax was to discredit the evidence.
Patrick Kane’s defense attorney has said his client’s DNA didn’t show up on any tests conducted from the victim.
Clark believes the accuser’s former attorney won’t face any repercussions because of this.
News 4 asked him if he thinks this case will be dismissed. Clark said he doesn’t know.
