ATTICA, N.Y. (WIVB) — An Attica woman indicted on a charge of killing her husband will be mentally evaluated by a third doctor, as per a Wyoming County Court order.
Charlene Mess was originally set to appear in court for a hearing on the morning of December 14, but the hearing has been cancelled.
During a previous court appearance, two doctors said Mess was not competent to stand trial — a decision that was disputed by Wyoming County District Attorney Donald O’Geen due to the short length of the examination and other factors.
Following this, O’Geen requested the now-cancelled December 14 hearing to allow people to present evidence rebutting the doctors’ opinions. The doctor performing the next evaluation will be chosen by the District Attorney.
If a new hearing date is necessary, it will be set when a new medical report is received by all parties involved in the case.
