Colden town justice resigns ahead of judicial probe

COLDEN, N.Y. (WIVB) — Colden Town Justice Victoria Zach has resigned effective Dec. 31.

News 4 has learned that the judge’s resignation is part of an investigation by the State Judicial Conduct Commission. The justice, who is not an attorney, allegedly represented herself as an attorney in two area courts.

Justice Zach could not be reached to comment.

Justice Zach submitted a letter of resignation to the town clerk on Dec. 9.

The Colden Town Board will meet on Tuesday night to accept the resignation and name Aurora Justice Jeffrey Markello to fill in until a new justice can be named.

Town Supervisor James DePasquale said today that he expects a replacement will be named sometime in the spring to allow the new justice to attend judge training school. Under state law, a town justice does not have to be attorney.
