Deep South Taco jumps another hurdle

(Plan for Deep South Taco's Hertel Ave. location.)

BUFFALO, N.Y. (WIVB) — An exciting new development in an abandoned gas station on Hertel Avenue has cleared another hurdle.

Developers say the Planning Board gave Deep South Taco’s second location a green light after its latest hearing, although it implemented some restrictions.

The Planning Board said the outside patio must close at 12 a.m. on weekends, rather than 1 a.m., can’t have speakers outside and must have one kitchen inside to serve the patio.

The approval is conditional for a year, when Deep South Taco must reappear in front of the Planning Board to resolve any issues.

Next, the restaurant will need to appear before the Buffalo Common Council at 2 p.m. on Tuesday. provides commenting to allow for constructive discussion on the stories we cover.
