Buffalo officer found guilty of a lesser DWI charge

BUFFALO, N.Y. (WIVB) — Last month, an off-duty Buffalo Police officer was caught drinking and driving in the Allen Street area. Officials said 49-year-old Dave Rodriguez was involved in a car crash and charged with a DWI. No one was injured in the accident.

Police said Rodriguez refused all sobriety tests.

Wednesday, an Erie County judge found Rodriguez guilty of a lesser DWI charge, driving while ability impaired. He is sentenced to a conditional discharge which requires him to live a law abiding life for one year. His driving license is also suspended for 90 days.

Rodriguez is a 23-year veteran of the Buffalo Police force, he’s currently on suspension with pay pending the investigation by internal affairs.

A year ago Rodriguez, who is openly gay, became the first uniformed officer to march in the pride parade in the Queen City. Rodriguez usually works in the accident investigation unit.
