Sheriff: Previously convicted drunk driver flips vehicle with child inside

TOWN OF ELLERY, N.Y. (WIVB) — A Jamestown man is facing felony charges after deputies with the Chautauqua County Sheriff’s Office say he drove drunk and flipped over with a child in the car.

Efrain Mariera, 36, was driving on Route 430 in the town of Ellery Sunday night when his vehicle flipped over.

Deputies were at the scene shortly after 8:15 p.m.

While there, they began to investigate Mariera, who was previously convicted of drunk driving within the last 10 years.

After deputies noticed there was a child younger than 16 in the vehicle, they filed charges against Mariera related to drunk, unlicensed driving.

Mariera was accused of felony DWI, felony aggravated unlicensed operation, driving without an interlock device, violating Leandra’s Law and other vehicle and traffic violations.

He was taken to WCA Hospital in Jamestown for treatment and will answer the charges in Town of Ellery court. provides commenting to allow for constructive discussion on the stories we cover.
