TONAWANDA, N.Y. (WIVB) — A Tonawanda man had a lot to tell police officers when he crashed into a pole in the city Thursday night.
Police responded to the scene at Young and Scott St. where they found 28-year-old Kyle Bak, who was uninjured.
When police began to question Bak, he told them “I was drinking all day and just finished a 25 ounce can of beer,” they say. In addition to this, police say Bak admitted to texting while driving.
During this time, Bak was tested, and officers say his blood-alcohol content measured out to .20 percent. To this alleged measurement, Bak replied “That’s conditioning, yeah!,” according to officers.
Bak was charged with DWI, aggravated DWI, driving an unregistered motor vehicle and operating an electronic device while driving.
He was taken into custody on $250 bail.
