Barry Moss case may not go to trial

BUFFALO, N.Y. (WIVB) – This story is developing.  The case against a woman accused in a deadly hit and run may not go to trial.

Gabriele Ballowe is charged with manslaughter.

Prosecutors say she was in an SUV that hit Barry Moss in Evans in December 2013. She’s also charged with leaving the scene of an accident.

Ballowe was indicted in June for the crash. She was not indicted in 2014 but the DA’s office reported new evidence in the case, including conflicting statements from co-defendant Lynn Laettner

This morning, Ballowe’s attorney Tom Eoannou said this case could be resolved without a jury trial, “Today we had a lengthy conference with the court.  The District Attorney’s office has forwarded a proposed resolution of this case.”
