Driver charged in fatal July accident

SARDINIA, N.Y. (WIVB) — A driver has been charged after a fatal July accident in Sardinia.

Erie County Sheriff’s deputies say Robert Sutherland was driving on Route 39 in the town when he crossed over the westbound shoulder and hit 22-year-old Samuel Pagano, a surveyor.

Deputies say that after he struck the Wales man, Sutherland’s vehicle continued forward, hitting a tree and knocking down a utility pole.

Sutherland was charged with second-degree vehicular manslaughter and committed to the Erie County Holding Center.
