Byron man dies after being hit by a train

BYRON, N.Y. (WIVB) — A Byron man has died after he was hit by a train Sunday morning.

New York State Police say 60-year-old David Swinton was near the train tracks around 10:30 a.m. when it happened.

An early investigation shows Swinton was a hunter and was photographing some deer in the area.

Authorities do not know exactly how he was hit but believe he was standing closely to the tracks near the overpass at Rt. 237.

Police say Swinton’s death is a tragic accident.

“CSX, State Police, the Sheriff’s Office, the fire department everybody. Stay away from the train tracks, especially an active line when they’re moving because accidents like this do happen and we don’t like to see it. This is just a tragic accident.” said Sargent Michael Notto.

Right now authorities do not suspect foul play. State Police say the train was operating within regulations.

The investigation is ongoing.
