SARDINIA, N.Y. (WIVB) — A man convicted of manslaughter and endangering the welfare of a child in the 2015 vehicle-related death of his son was sentenced to 2-6 years in prison Thursday.
Kevin McCabe had been accused of aggravated vehicular homicide and vehicular assault, but was acquitted of the charges.
McCabe, a resident of Belfast in Allegany County, was recklessly driving with his niece and 4-year-old son when they slammed into the back of a tractor trailer. Both children were riding in the truck’s front. McCabe’s son was killed.
Following the incident, McCabe was in a coma for days. The presence of methamphetamine was found in his blood during testing, but it could not be proven whether it was from illicit drugs or cold medicine.
Before his felony conviction near the end of September, McCabe had been free on $10,000 bail.
