CITY OF TONAWANDA, N.Y. (WIVB) – City of Tonawanda Police say they caught a man in the act of stealing metal shelving from behind a business Wednesday afternoon.

According to police reports, Michael McCurry, 58, of Dexter Street, Tonawanda, was loading metal shelving into a trailer of his pickup truck behind the Leisure Living warehouse at 574 Main Street when he was caught by police. McCurry attempted to leave the business and was blocked in by officers.

He was charged with fourth degree grand larceny, felony driving while intoxicated, third degree criminal trespassing, no driver’s license, and other vehicle and traffic charges.

The DWI was a felony due to a prior DWI conviction in 2008 in New York City, police said.

The metal shelving was valued at $1,800.

McCurry was combative with officers, refusing all DWI tests. He was held on $5,000 bail and is scheduled to appear in court Friday.
